Geomanic ("the Service") is a web-based GPS tracking and analysis platform operated by Monswyk AG, Switzerland ("the Operator"). By accessing or using the Service, you agree to be bound by the following terms and conditions. If you do not agree to these terms, you must not use the Service.
Geomanic is a Software-as-a-Service (SaaS) application that allows users to import, store, visualize, and analyze GPS waypoint data. The Service is provided for personal and informational purposes only. The Operator reserves the right to modify, suspend, or discontinue the Service, in whole or in part, at any time and without prior notice or liability.
The Service is currently provided free of charge as donationware. However, the Operator reserves the right to introduce paid plans or make the Service chargeable at any time if required for economic reasons. Users will be notified of any pricing changes with reasonable advance notice. In the event of such changes, users retain the right to export or delete their data before the changes take effect.
GPS data may be inaccurate or incomplete due to device limitations, signal interference, atmospheric conditions, or other environmental factors. The Operator does not guarantee the accuracy, completeness, or reliability of any location data processed through the Service. Users must not rely on the Service for safety-critical, navigation, or emergency-related decisions.
The Service may display statistics such as country visit counts or day-count summaries. These features are provided for informational purposes only and do not constitute tax, legal, or professional advice of any kind. The Operator makes no representation or warranty that any data, reports, or statistics generated by the Service will be accepted or recognized by any tax authority, government agency, or court of law. Users must consult a qualified tax or legal professional for advice regarding tax residency, the 183-day rule, or any other legal matters.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by applicable law, the Operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with the use or inability to use the Service. As the Service is provided free of charge, the Operator's total aggregate liability is limited to zero.
The controller responsible for data processing is Monswyk AG, Switzerland (full address available at www.monswyk.com). The Operator is committed to protecting your personal data in compliance with the General Data Protection Regulation (GDPR, EU 2016/679) and the Swiss Federal Act on Data Protection (FADP). All user data is stored on servers located in Nuremberg, Germany (European Union), operated by the Operator on infrastructure provided by netcup GmbH. -- Data collected: The Service collects the following personal data: email address (required for registration), display name (optional), and GPS waypoint data (coordinates, speed, altitude, timestamp) submitted by the user via connected tracking apps. No other personal information is required. IP addresses are processed transiently by the web server but are not stored. -- Legal basis (Art. 6 GDPR): Processing of account and GPS data is based on contract performance (Art. 6(1)(b)); analytics data processing is based on consent (Art. 6(1)(a)); security logging is based on legitimate interest (Art. 6(1)(f)). -- Data retention: Your data is stored for as long as your account exists. When you delete your account, all associated data (waypoints, API keys, settings) is permanently and immediately removed. -- Your rights: Under the GDPR, you have the right to: access your personal data (Art. 15), rectify inaccurate data (Art. 16), erase your data (Art. 17), restrict processing (Art. 18), data portability (Art. 20), and object to processing (Art. 21). You may withdraw your consent for analytics at any time via the Cookies link in the footer. You also have the right to lodge a complaint with a supervisory authority. -- Data portability: You can export all your data at any time using the backup function on the Data page, which provides a complete ZIP archive of your waypoints in JSON format. -- Data breach notification: In the event of a personal data breach, the Operator will notify the relevant supervisory authority within 72 hours in accordance with GDPR Article 33, and affected users without undue delay. -- The Operator does not sell, share, or disclose your personal data to third parties, except as required by law. Cookies are used only for essential functionality (authentication, language preferences) and, with your explicit consent, for analytics.
The Service uses Google Analytics (operated by Google LLC) with Consent Mode v2 for the purpose of understanding usage patterns and improving the Service. Analytics data is collected only after the user has given explicit consent via the cookie consent banner. No analytics cookies are set and no analytics data is transmitted to Google without your prior consent. You may revoke your consent at any time via the "Cookies" link in the page footer. Google processes analytics data in accordance with its own data processing terms. Data may be transferred to Google servers in the United States under standard contractual clauses (SCCs) as approved by the European Commission.
The Operator engages the following sub-processors to provide the Service: (a) netcup GmbH, Nuremberg, Germany -- provides the root server infrastructure on which all user data is stored and processed within the European Union; (b) Google LLC, United States -- provides analytics services (Google Analytics), activated only with explicit user consent, data processed under standard contractual clauses.
The Operator provides the Service on a best-effort basis. No service level agreement (SLA) or guaranteed uptime is provided. The Service may be subject to planned or unplanned downtime for maintenance, updates, or other reasons. The Operator is under no obligation to provide advance notice of downtime and shall not be liable for any interruptions or unavailability of the Service.
You must be at least 16 years of age to use the Service, in accordance with GDPR Article 8. By using the Service, you represent and warrant that you meet this age requirement. If we become aware that a user is under 16, we will take steps to delete their account and associated data.
The Operator reserves the right to suspend or terminate any user account at its sole discretion, without prior notice, in the event of misuse, violation of these terms, or any activity that may harm the Service or other users. Upon termination, the user's data may be deleted.
The Service, including its design, code, user interface, and documentation, is the intellectual property of Monswyk AG and is protected by applicable copyright and intellectual property laws. Users retain full ownership of their personal data uploaded to or generated by the Service.
Users are responsible for: (a) providing accurate account information; (b) maintaining the confidentiality of their login credentials and API keys; (c) all activities that occur under their account; (d) ensuring that their use of the Service complies with all applicable laws and regulations.
The Service may contain links to third-party websites or services (e.g. Buy me a Coffee). These external resources are not operated or controlled by the Operator. The Operator assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. Accessing third-party links is at the user's own risk.
The Operator shall not be liable for any failure or delay in performing its obligations under these terms where such failure or delay results from circumstances beyond the Operator's reasonable control, including but not limited to natural disasters, acts of government, power failures, internet outages, cyberattacks, or failures of third-party infrastructure providers.
The Operator reserves the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after any changes constitutes acceptance of the revised terms. It is the user's responsibility to review these terms periodically.
If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
These terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising out of or in connection with these terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
